Terms of Service

This agreement is between myself, Eos Lunaria (the "Artist"), and you (the "Client"). The client is hiring the Artist for a commission hereafter referred as "commission" and/or "artwork". Failure to comply with this Terms of Service may result in ban from future commissions, and will result in all rights and ownership to the commissioned artwork rescinded. I, the Artist, am not responsible if the Client fails to read/ confirm the Terms of Service. The Client is responsible to clarify with the Artist any policy they are unsure of.

General

  • Do not trace, reproduce any of my artwork

  • Do not edit, modify any of my artwork without my consent

  • Do not claim the artwork as your own creation

  • Do not use my artwork for AI-related activities, such as (but not limited to) AI training and AI generated works

  • Do not use my artwork for any blockchain-related activities, such as (but not limited to) NFTs and cryptocurrency

Commissions

  • The commission slot is reserved and work time starts after payment is settled

  • I reserve the right to decline any commission

  • All commissions are delivered digitally

  • ​Revisions are allowed but only during the sketch and rough layout phases

Pricing

  • Can only accept full payment upfront

  • Payment will be made through Paypal Invoice​

Refund and Cancellation

  • The Client must never request/ submit a Paypal chargeback under any circumstances. This will be considered a violation of my Terms of Service. If a refund has been agreed on, I will transfer the funds to you per our agreement

  • Platform fees will not be refunded

  • I will do a full refund in the following circumstances:

↳ 30 days have passed after payment and Work for the commission has not been done
↳ I, the Artist, cancels the commission for reasons relating to my inability to finish the Work, or for any misbehavior or violation committed by the Client

  • For cancellation mid-commission requested by the Client, a partial refund may be available but not guaranteed - the Artist will discuss with the Client with consideration to work done and workflow of said commission

  • Upon cancellation, partially completed work will not be sent to the Client

  • I, the Artist, maintain the right to reuse/ modify/ adopt the work in progress for another design/ artwork/ commission. Naturally I will not directly reuse any concepts unique to the previous Client, but will modify/ adopt them appropriately

Commercial Rights

  • +50% of the total commission cost

  • This Commercial Rights charge is required if you intend to use the artwork for mass printing, mass distribution and/ or profitable activities, , such as (but not limited to): 

Example 1: mass distribution of an artwork as a reward for a subscription tier

Example 2: printing the artwork for sale

Example 3: using the artwork in creating merch for sale

Example 4: monetized video creation such as music video, video commentary, animations etc.

 

Commercial Rights not required for use of the artwork on streams and video thumbnails
